General Terms and Conditions

1. Scope of application and contractual partners

These General Terms and Conditions (hereinafter referred to as GTC) apply to all orders for Gartner KG Fanshop items, regardless of the technical means by which they are placed and concluded with

2. Conclusion of contract

The product list/order list provided is used to submit a purchase offer. By completing, signing and sending it to fanshop@gartnerkg.com you are submitting a binding purchase order.
Your order is considered accepted by the sending of an order confirmation by e-mail or by delivering the ordered goods. The sending of a confirmation of receipt regarding your order does not constitute an acceptance of your order.
Shipping will take place at the earliest on the day of receipt of payment.
Orders will only be accepted from end consumers in quantities deemed customary for households. There will be no sale to resellers.

3. Terms of delivery

The delivery is carried out via Maillog or the Austrian Postal Service. Home delivery is carried out by the above-mentioned postal service providers themselves or by their delivery service providers. The delivery of purchased items to post office boxes or poste restante delivery locations is not possible.
We deliver within Austria and to Germany. Delivery to other EU countries must be requested separately. There is currently no delivery to non-EU countries.
Unless otherwise stated in the order confirmation, the delivery time is between 3 and 7 days after receipt of payment.
If not all ordered products are in stock, we are entitled to make partial deliveries at our own expense, as far as this is reasonable for you (even in these cases, only one shipping flat rate will be charged for all partial deliveries). If the ordered products are not available because they have not been delivered by our suppliers through no fault of our own, we may withdraw from the contract. In this case you will be informed immediately and we will suggest the delivery of a comparable product if possible. If no comparable product is available, or you do not wish to take delivery of a comparable product, we will immediately refund the amount already paid.
Should the delivery of goods fail due to your own fault despite three delivery attempts, we may withdraw from the contract. Payments made will also be refunded immediately minus the costs for shipping and delivery attempts.

4. Prices and terms of payment

The prices stated on the price list/order form include statutory VAT and other price components and do not include shipping costs. We offer the following payment methods: credit card, PayPal, Klarna, Apple and Google Pay, eps transfer and others.

Payment for commercial purchases is to be made exclusively by means of advance payment within 7 days to the following account:

If payment is not received within 10 days after transmission of the order confirmation, we are entitled to withdraw from the contract. You will receive separate information about our withdrawal by e-mail.

5. Right of withdrawal/right of revocation and applicable law

Austrian law shall apply, in particular the Consumer Protection Act (KSchG) and the Distance and Foreign Trade Act (FAGG).
After conclusion of the purchase contract, you have the right to withdraw from/revoke the contract within 14 calendar days without stating your reasons; notification of your withdrawal/revocation must be sent to the e-mail address: fanshop@gartnerkg.com using the form provided.
The cancellation policy and the cancellation form are enclosed with the order confirmation.

6. Damage in transit / Warranty

If goods with obvious transport damage are delivered, please register your complaint immediately to the respective deliverer and contact us without delay by email: fanshop@gartnerkg.com or phone: +43 7245 234 4318.
The relevant statutory warranty provisions apply.

7. Final provisions

Should a provision or parts of these Terms and Conditions be (or become) invalid, this shall not affect your remaining rights. The remainder of the contract remains valid and the legal regulations shall take the place of the invalid provisions.
